Intended Parents
You can achieve your dream of parenting through surrogacy, embryo donation, egg or sperm donor, depending on your own situation. I will provide you with step-by-step guidance in the process that meets your concerns.
Various states, other than New Jersey and New York, have laws that you can access to gain opportunities to achieve parenthood. I will guide you through the process of connecting with gestational carriers, egg donors, and embryo donors by internet postings and newspaper advertisements in these favorable states.
I will conduct the initial intakes of donors or gestational carriers. Psychological and medical screenings will be conducted before you enter into contracts with any donor or gestational carrier. I will prepare or review all contracts with you. I will refer the donor or gestational carrier to other skilled legal counsel for contract review and review of any required documents.
You will select the medical facility you prefer for all medical treatments required to achieve the pregnancy. However, gestational carriers may select their own OBGYN, as this is within their legal rights. My office can manage and maintain your trust funds. I will consult with you about your relationships with the donor or gestational carrier.
I will collaborate with co-counsel in states, other than New Jersey and New York, to obtain court orders to list you as parents on baby’s birth certificate. If legally allowable under limited circumstances in New Jersey and New York, based upon the specific facts involved in your situation, I will represent you in obtaining court orders demanding that your names be listed as the parents on baby’s (s’) birth certificate(s).
These definitions will assist you if you are beginning to consider assisted reproductive technology as your path to becoming parents:
Gestational Carrier is the woman who becomes pregnant by having an embryo implanted in her uterus at a medical facility selected by intended parents. The embryo is made with the ovum of intended mother or egg donor and sperm of intended father or sperm donor. The gestational carrier delivers baby.
Traditional surrogate is legally considered to be the birth mother. This is highly risky. The traditional surrogate delivers baby who was conceived through invitro fertilization using her ovum and the sperm of the intended father or sperm donor. If sperm is the intended father’s, then traditional surrogate must consent like a birth mother and the intended mother becomes mom by stepparent adoption proceedings. If sperm is donor, then full adoption proceedings must take place.
Egg Donor donates her ovum to the intended parents. She is typically anonymous, although there is a trend of disclosing identity.
Sperm Donor donates his sperm and is typically anonymous.
Surrogacy Contracts: In New York these contracts are unenforceable. Post-birth orders can be obtained if surrogate is a relative. In New Jersey, these contracts are enforceable only if gestational carrier receives no compensation and she consents at least 72 hours following baby’s birth.
Pre- birth or Post-birth orders determine the baby’s legal parentage. In New York, post-birth orders can be obtained. In New Jersey, pre-birth orders can be obtained but are not entered and enforceable unless the gestational carrier consents. In several states, pre-birth orders can be obtained even and compensation to the gestational carrier is allowed. These orders are required for the Vital Records to issue baby’s birth certificate containing the intended parents’ names. Otherwise, an adoption is required.
